TERMS OF USE
Elgon provides its services through its website located at http://www.mydprights.com/ along with related features, content, applications and products (the “Services”). Before using our Services, please read these terms of use (the “Terms”) carefully, along with any other policies or notices on the Services and our Privacy Policy.
The present Terms apply to your access and use of the (video) demonstration tool about our application “myDPRights” (the “Demo Product”). By using the present Demo Product, you agree to these terms of use. If you disagree with any part of these Terms, please do not use our Demo Product.
DEMO PRODUCT STATUS. The Demo Product is offering a limited video demonstration about the features of our application “myDPRights” (“myDPRights” or the “Solution”). This video demonstration aims to provide you with a general idea of the interest, functionalities and layout of our Solution. Demo Product is not an end-product (or a finished appliance), nor is it intended or authorized by Elgon to be integrated into end products. 
TERMS. The content of the Demo Product is for your general information and use only. You are authorized to use the Demo Product solely for your internal evaluation and testing purposes in order to assess whether or not the Solution may present an interest for you. It is subject to change without notice. Your use of any information or materials pertaining to the Demo Product is entirely at your own risk, for which Elgon shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this Demo Product meet your specific requirements. Neither Elgon nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found in the Demo Product for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and Elgon expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. You agree that you are solely responsible for your reuse of the Demo Product made available.
OWNERSHIP AND COPYRIGHT. Title to the Demo Product, demo software, related documentation, design, layout, look, appearance and graphics and all copies thereof remain with Elgon. You may not remove the copyrights notices, if any, from the Demo Product. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions. You may refer to the Demo Product provided that you reproduce and apply to such reference any copyright or other proprietary rights notices included on or embedded in the Demo Product. You agree to prevent any unauthorized copying of the Demo Product, demonstration software and related documentation.  
RESTRICTIONS. You may not sell, assign, sublicense, lease, rent or otherwise distribute the Demo Product for political or commercial purposes (unless you are an authorized Elgon distributor subject to a specific agreement). 
LIMITATION OF LIABILITIES. In no event Elgon shall be liable to you or any third party for any indirect, special, consequential, incidental, punitive damages or other damages (including but not limited to, the cost of labour, re-qualification, delay, loss of profits, loss of revenues, loss of data, costs of procurement of substitute goods or services or the like) whether based on contract, tort, or any other legal theory, relating to or in connection with the Demo Product, the documentation or these Terms, even if Elgon has been advised of the possibility of such damages. In no event shall Elgon’s aggregate liability to you or any third party under this agreement for any cause action, whether based on contract, tort, or any other legal theory, relating to or in connection with the Demo Product, the documentation or this agreement shall exceed the purchase price paid for the Demo Product if any. Furthermore, Elgon takes no responsibility for the content of external internet sites (meaning websites not managed by Elgon) on which the Demo Product could be found.
APPLICABLE LAW AND JURISDICTION. In case of dispute and in the absence of an amicable settlement, the only competent jurisdiction shall be the Courts of Luxembourg, Luxembourg. The applicable law shall be the law of Luxembourg.  
SEVERABILITY. If any provision of this agreement is or becomes, at any time or for any reason, unenforceable or invalid, no other provision of this agreement shall be affected thereby, and the remaining provisions of this agreement shall continue with the same force and effect as if such unenforceable or invalid provisions had not been inserted in this Agreement.  
WAIVER. The waiver by either party of any breach of any provisions of this Agreement shall not operate or be construed as a waiver of any other or a subsequent breach of the same or a different provision.
