The ZenCity Insights application (the "Application") provides managers of municipalities (“Cities”) with an interface for understanding trends in citizen attitudes towards the infrastructure, services and other aspects of the City in order to provide valuable and actionable insights aimed at operating Cities in a better, more citizen-centric way. In general, ZenCity believes in an abiding respect for privacy, and has built its analytics platform in a manner consistent with such respect. ZenCity strives to be considerate of individual privacy in all aspects of data collection and analysis. This privacy statement details ZenCity’s policies regarding the collection, use, disclosure and protection of information. ZenCity is currently not available in Europe. ZenCity does not provide services to Cities located in Europe and does not intentionally collect data regarding European data subjects. Information We Collect ZenCity collects citizen data from multiple sources, including data provided to ZenCity by a specific City (such as, for example, City hotlines or sensors) or publicly available information (such as public conversations and communications on social media sites and the Internet). The data may include citizen requests submitted to 311 without the requester information, as well as posts, comments, interactions and tweets from different social media platforms such as Facebook, Twitter and Instagram. We do not collect the user’s information, but occasionally may collect names mentioned in the content of such requests and social media data items. ZenCity also collects data from users of the Application. This can include information that personally identifies a user (such as name or account information) or that relates to how a user is using the Application (such as the features of the Application used by any specific user, login and crash data, and information regarding a user’s device and operating system). We may also receive feedback from specific users. How We Use Information We use data regarding our users to make informed decisions about improving the Application. In addition, we use data regarding citizens of a specific City to: Measure relevance of data to any specific City, using our algorithms. These measurements can take into account the location of the citizen and interactions of the citizen with City services. Discover citizen sentiment, using our algorithms to analyze communications and actions of the citizen. Display aggregated data (in the form of graphs and charts) to Cities that subscribe to our services, but not publicly, and allow the Cities to search the data; In certain circumstances, provide public access to aggregated, deidentified data (such as top trend graphs or volume of conversation about certain topics in a city); We will not share personally identifiable information with third parties without the explicit permission of the applicable citizen or user, except when required by law, regulation, subpoena or court order or as otherwise expressly set forth herein. We may use personally identifiable information and other information internally – for example, to help diagnose problems with our services, to make our services more useful for users and customers and to develop new services, features and functionality. We may use non-personally-identifiable information (including automatically collected technical information that does not identify any individual) available to third parties for various purposes, including (i) compliance with our legal reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests usage patterns. By analyzing all information we receive, we may compile statistical information across a variety of users (“Statistical Information”). Statistical Information helps understand trends and customer needs so that new services can be considered and so our services and associated technology and services can be tailored to customer desires. We may share Statistical Information with our partners, pursuant to commercial terms that we determine in our sole discretion. In addition, we may provide any information to third parties, so long as we have removed any information that identifies any specific individual or user, such as a name, address or contact information. We may use your information to contact users for administrative purposes such as customer service or to provide promotional messages. How We Protect Information We follow generally accepted industry standards to protect the data submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee its absolute security. Other Uses or Transfer of Your Information Notwithstanding anything to the contrary herein, we will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity, behavior or digital content of any user suspected to have engaged in illegal or infringing behavior. We will comply with any applicable law that requires the collection and provision of your data to the applicable authorities. We may use subcontractors that are located in countries other than your own, and send them information we receive. For example, we may send your information to any countries outside the United States or the European Economic Area. All our subcontractors will be subject to non-disclosure and non-use obligations. Nevertheless, some countries may have levels of protection of personal and other information which are not as high as in your country of residence or business. We may disclose data and information as necessary for us to enforce our agreements and policies, to investigate any claims against ZenCity, and to protect the rights and property of ZenCity or its agents, employees and customers. We may disclose data as we reasonably believe necessary to investigate and protect the security of our software, servers and other equipment. We may disclose or transfer data and information in connection with a sale of all or part of our business, or in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets. Children ZenCity does not knowingly collect personally identifiable information from children under the age of 13. Third Party Services and Services ZenCity may use third parties to process information. We cannot accept responsibility for the privacy policies of any specific City. Individual Cities may be required to provide or disclose information pursuant to specific laws. Applicable Law We will not share any personal data with third-parties to the extent prohibited by applicable law. Do Not Track The State of California requires that operators of websites and online services to disclose how they respond to a Do Not Track signal. Some browsers have incorporated “Do Not Track” features. Because there is not yet a common understanding of how to interpret Do Not Track signals, we do not currently respond to Do Not Track signals. Changes ZenCity may update this Privacy Policy from time to time. We encourage you to review it periodically.
