The software which accompanies this license is the property of Aquaforest Ltd and is protected by international copyright law. All rights reserved. The content of this software and its manual is subject to change without notice. No part of the manual may be reproduced either electronically or mechanically without the prior written consent of Aquaforest Ltd.
This License Agreement ( Agreement ) is a legal agreement between Aquaforest Ltd, registered in England number 4344383 and you, the user ( Licensee ), and is effective the date Licensee installs the package containing the CD, Disks or downloads the files electronically.
Use of the Aquaforest OCR SDK Software (Software) requires one SDK license per developer. "Developer" is defined as an individual engaged in the development of a software application (the "Application").Licenses are non-transferable between developers. For example, if a company has two developers that will use the Software, said company requires two licenses. This is the case even if the developers will not be working with the Software at the same time. This is also the case if a project involving the use of the Software is transferred from the original developer to a new developer and if the original developer returns within a one-year period.
The SDK license is purely for the purposes of software development only. It does not cover deployment for use by end users or for use on a server.
Aquaforest Ltd, will license the software to you only upon the condition that all of the terms contained in the license agreement printed below are accepted by you. Please read the terms carefully before installing the program, as installing the programs will indicate your acceptance to all of the terms of this license agreement. If you do not agree to the terms, Aquaforest Ltd will not license the software to you, in which case please return the unopened package and all accompanying material to Aquaforest Ltd or your authorized dealer for a full refund within 30 days of purchase.
A Desktop Runtime License is required to deploy the software on end-user PCs. "Desktop" is defined as an "end-user" personal computer (PC) that may have Applications installed that utilize the Software. The Applications must not support unattended document processing. No more than 10 page images may be processed without requiring human intervention.
A Server Runtime License is required to deploy the software on a Server. A Server is defined as a physical or virtual machine that is used for automated unattended processing or to provide services to multiple end users.
If the Software is an upgrade, it, and the product that was upgraded, constitute a single copy of the Software for purposes hereof and the upgrade and product that was upgraded cannot be used by two people at the same time. That is to say, that one purchased upgrade equals one license only.
Licensee may not use, copy (other than for archival purposes only), rent, lease, sell, sublicense, assign or otherwise transfer the Software or any copy, modification, or merged portion, in whole or in part, except as expressly provided for in this Agreement. Licensee acknowledges that the Software, in source code form, remains a confidential trade secret of Aquaforest Limited and/or its suppliers and therefore Licensee agrees that it shall not modify, decompile, disassemble or reverse engineer the Software or attempt to do so except as permitted by applicable legislation. Licensee shall not reproduce, copy or transfer any Documentation.
Licensee acknowledges that the Software is a confidential trade secret of Aquaforest Ltd. and agrees to refrain from disclosing the Software (and to take reasonable measures with its employees to ensure they do not disclose the Software) to any person, firm or entity except as expressly permitted herein.
LICENSEE may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that it is expressly permitted by applicable law notwithstanding this limitation.
This Agreement does not allow for exposing of the application programming interface (API) functionality to non-licensed users. LICENSEE may not create a dynamic link library (DLL) that exposes or wraps functionality of the SDK to a non-licensed developer. Violation of this stipulation is subject to the interpretation of Aquaforest and no other party. Aquaforest reserves the right to seek punitive damages including, but not limited to, lost income from sales.
Licensee may not use the SDK to create products that compete with any product sold by Aquaforest.
If Licensee wishes to use the Software in a manner prohibited by this Agreement, Licensee should contact Aquaforest Ltd. to determine whether a special license may be obtained.
THE SOFTWARE CONTAINED EITHER IN THESE FILES OR IN THIS PACKAGE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. THIS INCLUDES, BUT IS NOT LIMITED TO, MERCHANTIBILITY AND FITNESS FOR A PARTICULAR FUNCTION. THE ENTIRE RISK RELATED TO PRODUCT PERFORMANCE OR QUALITY IS ASSUMED BY THE USER. IN THE UNLIKELY EVENT A DEFECT IS DISCOVERED, YOU ASSUME THE ENTIRE COST OF ANY REMEDIAL ACTION. AQUAFOREST LIMITED'S ENTIRE LIABILITY IS LIMITED TO THE ORIGINAL PURCHASE PRICE OF THE SOFTWARE. SOME US STATES DO NOT ALLOW EXCLUSIONS OF IMPLIED WARRANTIES, THUS THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.
Aquaforest Ltd does not warrant the programs contained in this package will meet your requirements or that the programs will function in an uninterrupted and error free manor. Should the CD, or disks be damaged or rendered unusable under normal use, Aquaforest Ltd will replace them within the first 90 days at no additional charge. Evidence of purchase (original sales receipt) is required for replacement.
