Any order (“Order”) placed by a Customer through the Microsoft Azure Active Directory – Azure Marketplace herein ("Marketplace") is subject to the terms and conditions of any existing software licensing and services agreement or similar agreement ("Existing FLA") between the Customer and Kubeark. The Existing Terms shall govern the use, licensing, and services related to the Kubeark Platform purchased through the Marketplace, and the Order shall be considered to have been placed by Customer under the Existing FLA.
 
In the event that there is no Existing FLA between the Customer and Kubeark, the purchase, usage, and related services of the Kubeark Platform will be governed by the terms and conditions outlined in the Framework Licensing Agreement ("FLA"), accessible at this link: https://kubeark.com/hubfs/legal/2023.02.25Kubeark-FLA-website.pdf (or successor website).
 
Trial or demo licenses are subject to entering a separate agreement between Customer and Kubeark.
