Terms of Use for Cloud Function Service Marketplace Listing

These Terms of Use ("Terms") govern your use of the Cloud Function Service ("Service") provided through the marketplace listing ("Listing"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

Description of Service: The Service allows users to access and utilize cloud functions for various computing tasks.

License Grant: By accessing the Service, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service solely for your internal business purposes and in compliance with these Terms.

Restrictions: You shall not:
a. Modify, adapt, or create derivative works of the Service;
b. Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Service to any third party;
c. Reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Service;
d. Use the Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these Terms;
e. Use the Service to infringe upon the intellectual property rights or privacy rights of others;
f. Use the Service to transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.

Intellectual Property: All rights, title, and interest in and to the Service, including all intellectual property rights, are and will remain the exclusive property of the service provider. These Terms do not grant you any right, title, or interest in or to the Service.

Payment: The use of the Service may be subject to payment of fees as specified in the Listing. By using the Service, you agree to pay all applicable fees in accordance with the terms specified in the Listing.

Termination: The service provider reserves the right to suspend or terminate your access to the Service at any time for any reason without prior notice or liability.

Disclaimer of Warranties: The Service is provided on an "as-is" and "as-available" basis, without any warranties of any kind, either express or implied. The service provider disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: In no event shall the service provider be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if the service provider has been advised of the possibility of such damages.

Indemnification: You agree to indemnify and hold harmless the service provider and its affiliates, officers, directors, employees, agents, and licensors from and against any and all losses, expenses, damages, liabilities, and costs, including attorneys' fees, arising out of or in connection with your use of the Service or violation of these Terms.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the service provider is located, without giving effect to any principles of conflicts of law.

Changes to Terms: The service provider reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
