These Terms of Service ("TOS") outline the terms and conditions governing the use of Zenisort's proprietary email inbox organization and management software-as-a-service offering ("Service"). By signing up for the Service, you agree to abide by these TOS. References to "you" or "users" in these TOS refer to the individual or entity accessing or using the Service. If you are accepting these TOS on behalf of an entity, they will form a legally binding agreement between Zenisort and that entity. You represent and warrant that you have the authority to bind such entity to these TOS.

Enjoy Zenisort during your free seven days trial period. After the trial, you can choose from our paid subscription plans tailored to suit your needs. If you decide Zenisort isn't for you, you can cancel your subscription at any time.
Please note that to use Zenisort, you must be at least 13 years old, or have legal parental or guardian consent. Your use of the Service is subject to your payment of applicable subscription fees, as outlined on our website (www.zenisort.com), and your ongoing compliance with these Terms of Service. Zenisort reserves the right to refuse service to anyone at any time and may modify eligibility criteria at its sole discretion.

Zenisort reserves the right to modify these Terms of Service. Any revised Terms will be posted on this page at least 30 days before the changes take effect.
You acknowledge and agree that Zenisort may update these Terms at any time by posting an updated version on the Site at least thirty (30) days before the changes take effect. If you do not agree to the revised Terms, you may terminate these Terms by notifying Zenisort in writing before the changes become effective, and Zenisort will promptly refund any amounts paid for the unused portion of the Service. By continuing to access or use the Service after Zenisort updates the Terms, you agree to be bound by the revised Terms. Zenisort does not function as a spam filter nor does it scan for viruses or potentially unsafe messages. Instead, our algorithms assess the importance of an email using various methods. It's important to note that none of these methods involve analyzing the content of the email. Therefore, it is ultimately up to the user to determine the authenticity and safety of each email. We strongly advise users to exercise caution when interacting with email links. All links should be treated with suspicion, and clicking on them should be done with extreme care. The safest approach is to copy the link into a browser and verify that the domain matches the legitimate business or person you recognize. Please remain vigilant when navigating your inbox. Zenisort operates under the assumption that email is not intended for real-time communication. For example, it's unlikely that someone would use email to request an ambulance in an emergency situation. Zenisort cannot be held responsible for any consequences arising from the delay between when a user receives non-Inbox email and when they read and process it. Additionally, Zenisort is not liable for any consequences resulting from user error in training emails to folders.

Privacy Policy
Zenisort values the privacy of its users and adheres to the privacy principles outlined in our Privacy Policy. By using our services, you agree to the terms outlined in our Privacy Policy, which is hereby incorporated into these Terms of Service.

Accuracy and Security
With extensive experience in this field, ensuring security remains our utmost priority. We implement reasonable security measures to safeguard against the loss, misuse, or unauthorized access of personally identifying information under our control. However, it's important to acknowledge that no security system is flawless. Despite our efforts to protect personally identifying information, we cannot guarantee the security of any information transmitted through or stored on the Site or the Service. This includes any computers, servers, storage devices, or other computer or telecommunications infrastructure utilized in providing the Service, whether owned or operated by us or any third party. We do our best to safeguard personal information but acknowledge no system is flawless. In case of a breach, we have procedures in place. We take reasonable steps to protect confidentiality, security, and integrity of collected personal information. It's stored in secure environments accessible only to authorized employees. In the event of a breach, we have protocols to protect consumer data. We rely on third-party subscription providers for financial transactions. While reputable, we don't endorse or assume responsibility for their security measures. Third-party subscription providers manage all aspects of your financial transactions for purchasing Zenisort products. We don't guarantee the security or any other aspect of their systems. Site and Service Usage
We reserve the right to revoke access to Zenisort if you violate the TOS. Access may also be revoked at our discretion with 30 days' notice. Revocation means you can't use Zenisort, but your email account remains fully accessible. You acknowledge and agree that Zenisort may cease providing the Service to you, either permanently or temporarily, at Zenisort's sole discretion, without prior notice, if you violate these TOS. Additionally, Zenisort may terminate these TOS and your access to the Service for any reason or no reason by providing thirty (30) days' prior written notice. If Zenisort terminates the Service or these TOS for any reason other than your breach, we will refund any unused portion of the Service fees. If Zenisort disables access to your account, you may not be able to use the Service or access associated information. However, any suspension or termination of the Service will not affect your ability to access your email account. These Terms do not authorize you to use Zenisort trademarks, logos, domain names, or other brand elements, nor do they grant a license to any software. All rights, title, and interests in the Service, including intellectual property rights, remain with Zenisort. Content on the Site is protected by copyright laws and may not be used or reproduced without Zenisort's prior written consent. The Site may include links to third-party sites on the Internet (referred to as "External Sites") owned and operated by third parties. You understand that Zenisort is not responsible for the availability of, or the content located on or through, any External Sites, including their privacy policies or other terms applicable to your use of those sites. If you have concerns about such links or the content on External Sites, please contact the site administrator or webmaster of those External Sites directly. We value your feedback and are continuously striving to enhance our services. You may, at your discretion, provide feedback to Zenisort regarding the functionality and performance of the Service, including identifying potential errors, improvements, modifications, bug fixes, or enhancements ("Feedback"). While we appreciate your input, please note that we may utilize any feedback, comments, or suggestions you provide via social media or other channels without any obligation to you. By submitting Feedback, you assign ownership of all Feedback to Zenisort. If ownership cannot be granted, you grant Zenisort a perpetual, irrevocable, royalty-free, worldwide, transferable right and license, with the right to sublicense, to use, reproduce, disclose, sublicense, distribute, modify, and otherwise exploit such Feedback without restriction.

Prohibited Use
You agree not to manipulate or misuse our system in any manner. Use it as intended, and we'll both benefit! As a condition of using Zenisort's services, you agree not to:

Access, tamper with, or use any non-public areas of Zenisort's systems or its providers' systems.
Attempt to probe, scan, or test the vulnerability of Zenisort's systems or any related system or network, or breach any privacy, security, or authentication measures.
Reverse engineer or attempt to discover the underlying source code or algorithms of the Service.
Provide access to or utilize the Service under a time-share or service bureau arrangement.
Interfere with, or attempt to interfere with, the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing Zenisort's systems or its providers.
Impersonate or misrepresent your affiliation with any person or entity.
If you engage in any actions to manipulate our system, access non-public areas, or infringe upon our algorithms, etc., we reserve the right to take legal action against you. Zenisort retains the right to investigate and pursue legal action for violations of the above terms, including infringement of intellectual property rights and security-related issues, to the fullest extent permitted by law. Zenisort may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms of Service. You acknowledge that Zenisort is not obligated to monitor your access to or use of the services but reserves the right to do so to operate the Service, ensure compliance with these Terms of Service, or comply with applicable laws or court orders. We take GDPR compliance seriously. As of May 25, 2018, if you are a legal entity and have not accepted the Zenisort Data Processing Addendum, you agree to cease processing Client Personal Data regulated by EU Data Protection Laws until the Addendum is in full force and effect. This obligation does not apply to individuals. Legal entities agree to indemnify and hold harmless Zenisort from any losses resulting from a breach of this obligation.

Warranties
Your use of our services is at your own risk. We do not provide warranties. The Site and the Service are provided "as is," without warranty of any kind, whether express or implied. Zenisort explicitly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Zenisort makes no warranty that the services will meet your requirements or will be available on an uninterrupted, secure, or error-free basis. Your use of the services is at your own risk.

Indemnity
You agree to defend, indemnify, and hold harmless Zenisort, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising from your access to or use of the Services, or your violation of these Terms of Service.

Limitation of Liability
We are limiting our legal liability to you. Zenisort takes no responsibility for the content of its users' data. To the maximum extent permitted by law, Zenisort will not be liable to you or any third party for any incidental, special, consequential, or punitive damages arising out of or in connection with these Terms of Service or the use or inability to use the Services. This includes any user information sent through, stored by, or downloaded from the Services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if Zenisort has been informed of the possibility of such damages. You acknowledge and agree that Zenisort will not be responsible for any damages to your computer system or to the computer system of any third party resulting from the use of the Services. In no event will Zenisort's aggregate liability to you or any third party claiming under or through you for any and all claims arising out of or in connection with the use of the Services exceed the amount actually paid for such Services during the six (6) months preceding the date the circumstances giving rise to such damage first arose. The limitations of damages set forth above are fundamental elements of the basis of the bargain between Zenisort and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver
The failure of Zenisort to enforce any right or provision of these Terms of Service will not be considered a waiver of such right or provision. Any waiver by Zenisort of any provision of these Terms of Service must be in writing and signed by an authorized representative of Zenisort.

Controlling Law and Jurisdiction
These Terms of Service and any disputes arising from or related to them will be governed by the laws of Portugal, without regard to its conflict of law provisions. Any legal actions or proceedings arising out of or in connection with these Terms of Service shall be brought before the courts located in Lisbon. By using our services, you consent to the exclusive jurisdiction and venue of such courts and waive any objection to jurisdiction or venue.

Entire Agreement
These Terms of Service represent the complete agreement between Zenisort and you concerning the Service, replacing any previous agreements. Additional terms and conditions may apply to specific Zenisort services, affiliate services, or third-party content software or services that you use or purchase.

Refunds
If our service doesn't meet your expectations, please let us know. We'll do our best to address any concerns and ensure your satisfaction with Zenisort. If we're unable to resolve the issue, we'll gladly refund your payment within 30 days of purchase.
