Scope of the Service: Crowdbotics will perform an AI-powered analysis of the Customer's current development process using the Crowdbotics CodeOps AI Assessment, based on the Customer's internal project board data, as provided by the Customer.
Customer Data Protection:
Confidentiality and Security: Crowdbotics agrees that the Customer's raw data will be handled with strict confidentiality. It will not be published, circulated, or disclosed to third parties without the Customer's express written consent.
Data Retention: Crowdbotics agrees to retain the Customer's raw data for a period not exceeding 90 days from the date of receipt. After 90 days, the raw data will be permanently deleted from Crowdbotics’ systems.
Usage of Derived Materials: Crowdbotics retains the right to store and use materials produced by Crowdbotics in the course of this assessment, excluding proprietary insights or methods unique to the Customer's operations. These materials may include, but are not limited to, generalized observations and recommendations that do not disclose specific proprietary or confidential information of the Customer.
Data Processing and Analysis: By default, the Customer's data will be processed through Crowdbotics' private Azure OpenAI instance. Azure OpenAI is a secure platform that complies with industry standards for data security and privacy. The Azure OpenAI data, privacy, and security policy is available for review at https://learn.microsoft.com/en-us/legal/cognitive-
services/openai/data-privacy. The Customer may provide their own Azure OpenAI credentials if they wish to run the analysis through their own system, and Crowdbotics will provide reasonable support and guidance to facilitate this. The Customer will be responsible for the associated charges, including but not limited to, usage and subscription fees related to their own Azure OpenAI instance.
Customer's Responsibilities:
Data Provision: The Customer is responsible for providing an export of the relevant internal project board as input for the CodeOps Assessment.
Data Accuracy: The Customer warrants that the data provided is accurate and representative of the Customer's actual project data.
Disclaimer of Liability: Crowdbotics shall not be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the performance or provision of the CodeOps AI Assessment.
General Provisions:
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which Crowdbotics is incorporated.
Amendments: This Agreement may only be amended in writing, signed by both parties.
Entire Agreement: This Agreement constitutes the entire understanding and agreement between the parties regarding its subject matter.

BY UTILIZING THE CODEOPS AI ASSESSMENT SERVICE, THE CUSTOMER AGREES TO BE BOUND BY THESE TERMS AND CONDITIONS.
