About RxGenius.ai RxGenius.ai is an enterprise-ready generative AI pharmacy assistant solution that helps e-pharmacies build custom AI solutions and integrate them into their websites. We provide a zero-code platform that is trained with extensive pre-trained medical and pharmaceutical knowledge, your e-pharmacy real-time product listing and details, your other contents, and frequently asked questions (FAQs). 3. Your Use of the Platform You agree to use RxGenius.ai in a lawful and responsible manner. After integration, You may use the Platform to: Find the right over-the-counter (OTC) medications for your needs Ask questions about medications based on pretrainings and product details Offer basic customer service in over 30 languages Get insights on the intents, pain points and trends of customers You may not use RxGenius.ai to: Engage in any illegal or unauthorized activity Violate the intellectual property rights of others Transmit any unsolicited or unauthorized advertising, promotional materials, or other forms of solicitation Impersonate any other person or entity Upload or transmit any viruses, malware, or other harmful software Disrupt or interfere with the operation of RxGenius.ai or any other user's ability to use RxGenius.ai 4. License RxGenius.ai grants you a non-exclusive, non-transferable, revocable license to use RxGenius.ai for your internal business purposes only. You may not modify, copy, distribute, sell, or lease RxGenius.ai, or any part of it, without RxGenius.ai's prior written consent. 5. Intellectual Property RxGenius.ai and all related technology and content are protected by copyright, trademark, and other intellectual property laws. RxGenius.ai owns all rights, title, and interest in and to RxGenius.ai, including all intellectual property rights therein. 6. Our Use of Your Information We may collect and use your information in accordance with our Privacy Policy, which can be found at https://www.rxgenius.ai/privacy_policy.html. 7. Your Responsibility for Your Use of the Platform You are solely responsible for your use of the Platform and any consequences of such use. WE DO NOT WARRANT THAT THE PLATFORM OR SERVICES WILL BE ERROR-FREE OR THAT THEY WILL MEET YOUR REQUIREMENTS. 10. Limitation of Liability IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR ENTIRE LIABILITY TO YOU UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US FOR THE PLATFORM OR SERVICES IN THE LAST 12 MONTHS. 11. Indemnification You agree to indemnify and hold harmless RxGenius.ai from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with your use of RxGenius.ai. 12. Changes to Terms and Conditions RxGenius.ai may modify these Terms and Conditions at any time by posting the modified Terms and Conditions on the RxGenius.ai website. Your continued use of RxGenius.ai after such modifications will constitute your acceptance of the modified Terms and Conditions. 13. Entire Agreement These Terms constitute the entire agreement between you and us with respect to your use of the Platform and Services. These Terms supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. 14. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Dispute Resolution Any disputes arising out of or in connection with these Terms shall be resolved exclusively in the competent courts of Germany. Severability If any provision of these Terms is found to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect. 17.
