Privacy policy and terms of use Privacy is a subject with great importance for Big Brain! For this reason, this document seeks to detail to Users how their information is used in our products. It is recommended that Users read carefully. This Privacy Policy applies to all users of Big Brain products, containing clear information on data collection, use, storage and protection. Big Brain may change this Privacy Policy at any time and the User is responsible for regularly reviewing these terms. Customers may access it for different purposes, whether using a Big Brain subscription for example, and in any of these uses expressly authorize Big Brain to collect and store their personal (full name, social security number and phone number) and professional (corporate email) information, using them as provided in this Privacy Policy. This Policy applies to all products and applications made available by Big Brain, and there may be specific terms for certain products, which will be timely informed to the User. Collection and Use of User Information I - Personal Information When using Big Brain products and subscriptions for any purpose, personal information will be collected which may include, but is not limited to, name, email, mobile phone, social security number. The data provided by the User is his responsibility. The personal data informed by the User will not be disclosed and will only be stored within the platform, being essential to enable the access and permission of the Users themselves. It is possible that information of users remains stored even after a user account has been terminated. This storage can be occur if it is mandatory to comply with judicial, legal or regulatory obligations to prevent fraud or misuse, as well as to ensure strict compliance with this Privacy Policy and other agreements governing the relationship between Big Brain and its customers. II - Professional Information Big Brain will also collect and use professional information from its Users, internally on its platform. Professional information will be used to (i) popularize and describe users within Big Brain systems, software and applications; (ii) bring its Users closer (Institution and User) closer and ensure the effectiveness of your tools; (iii) provide the User with an experience appropriate to their registration profile. When using Big Brain products and subscriptions, professional user data will not be made available to third parties or any institutions and individuals. Data is stored on a Big Brain private server, data referent to Office 365 products will be handled in accordance with the Microsoft privacy policy, which can be accessed at the following link: Microsoft Privacy Policy. Professional data is made available entirely by the contracting institution and relates to the Integration process, which consists of integrating and including employees and information relevant to the educational institution within the Big Brain Provider platform and Microsoft Sharepoint. III - How to Access and Control Your Personal Data Microsoft Since Big Brain has a partnership with Microsoft, you can also make choices about the collection and use of your data used by Microsoft. You may control personal data obtained by Microsoft and exercise your data protection rights by contacting Microsoft or using any of the various tools provided by Microsoft. Access to or control of your personal data depends on the products you use. For example, you can: • Control the use of your data for Microsoft interest-based advertising by going to the Microsoft Data Control page to cancel. • Access and clean your data through the Microsoft Privacy Panel. IV - Cookies and Similar Technologies Cookies are small text files placed on your device to store data that may be remembered by a web server in the domain that placed the cookie. We use cookies and similar technologies to store and respect your preferences and settings, allow you to log in, combat fraud, analyze the performance of our products, and serve other legitimate purposes. V - Microsoft Account The utilization of Big Brain products and subscriptions consisting of a consumption of a Microsoft account for access and control. With a Microsoft account, you can log on to Microsoft products as well as Big Brain products. Personal data associated with your Microsoft account includes credentials, name and contact details, payment data, device and usage data, your contacts, information about your activities and your interests and favorites. Logging in to your Microsoft account enables consistent personalization and experiences across products and devices, enable you to use cloud data storage, enable you to make payments using the payment methods stored in your Microsoft account, and enables other features. There are three types of Microsoft account: • When you create your own Microsoft account linked to your personal email, we call this Microsoft personal account. • When you or your organization (such as an employer or school) creates your Microsoft account linked to your email address provided by that organization, we call this account of corporate or school account. • When you or your service provider (such as your internet or cable service provider) create your Microsoft account linked to your email with your service provider's domain, we call this account of a third party account. If you log into a service provided by Big Brain with your Microsoft account, you will share with this supplier the account data required for this service. VI - Company Products and Developer The Company Products and Developer are the software related and Microsoft products that are offered to or designed primarily for use by developers and organizations, such as Big Brain tools and applications. They include: • Cloud services referred to as Online Services under Microsoft Online Services (OST) Terms, such as Office 365, Microsoft Azure, Microsoft Dynamics365, and Microsoft Intune, for an organization to contract with Microsoft services. • Server and developer products, such as Windows Server, SQL Server, Visual Studio, and System Center. • Professional services mentioned in the OST that are available with Company Online Services, such as integration services, data migration services, data science services, or services to supplement existing features of Company Online Services. In the event of a conflict between this Big Brain privacy policy and the terms of any contract of Microsoft Company relative to Company Products and Developer, the terms of those agreements will govern. If any of the terms below are not defined in this Privacy Policy or OST, follow the definitions below. When a customer tries, buys, uses, or subscribes to Big Brain products, or gets professional support or services for those products, Big Brain being a Microsoft Partner organization, data is provided to Microsoft that collects data to provide the service, including compatible uses with the services provision, providing the best experiences with our products, conduct our business and communicate with the customer. For example: • When a customer enters into a contract with a Microsoft sales representative, Microsoft may collect the customer's name and contact information, along with information about the customer's organization, to support that agreement, which data is under Microsoft's own safeguard. • When a customer interacts with a Microsoft support professional, device and usage data or error reports are used to diagnose and resolve issues, which are under Microsoft's own protection. • When a customer pays for Microsoft products, contact and payment information is used to process the payment, which is under Microsoft's own protection. • When we send communications to a Microsoft customer, data is used to customize the content of the communication, which is under Microsoft's own protection. Company Products and Developer allow you to purchase, subscribe to or use other online products and services from Microsoft or third parties with different privacy practices, and these other online products and services are governed by their respective privacy statements and policies.
