Article 1 Software License The right to use JEUS 8 Enterprise Edition (hereafter “software”) refers to non-transferable, non-commercial, non-exclusive, and limited usage of this software solely for your company’s internal use. This software is distributed for a specific business purpose. The exclusive use or reuse of this software for a purpose other than the specified purpose is in violation of the license agreement. This license is valid for one year from the date of first usage of this software. The date of first usage is assumed from when the software is stored in temporary memory or installed in permanent memory (hard-disk, CD-ROM, or other storage devices). The use of this software outside the boundaries described in this agreement or any additional agreements is strictly prohibited such as any copy, change, redistribution, sub-licensing, reverse engineering, and unauthorized use of the software. Violation of this condition will result in immediate termination of this agreement and the violator will be liable for all damages resulting from the violation, regardless of whether the agreement is terminated. Article 2 Intellectual Property Your company is allowed limited usage of this software for the usage period. TmaxSoft has sole ownership of the software’s legal rights (regardless of whether they have been registered) such as intellectual properties. The permission to use this software in the agreement does not refer to the transfer of intellectual property of this software in any cases. If TmaxSoft's intellectual property rights are violated by the actions of you, your company, or company employees, your company is fully liable under both civil and criminal law and shall pay compensation for all damages resulting from the violation. Article 3 Confidentiality Usage of TmaxSoft’s business and technical secrets obtained through the use of this agreement and software is prohibited. Dissemination of these business and technical secrets to a third party is also prohibited. Your company is fully liable under both civil and criminal law and shall pay compensation for all damages incurred by you, your company, or company employees that disseminate the secrets to a third party.
